We had our first hearing against BBVA bank on Tuesday 2nd  Dec, we did not attend but solicitor said it went well, 

judge has set the hearing date for Nov 2015 at Alicante court again, a long way off but expected.

Lets hope by then the banks have stopped appealing everything!

Good to hear that you've been given a hearing date. We are still waiting to have our date in court. It's a long time coming but at least the courts appear to be correctly applying the law 57/68 and so many purchasers have been refunded. Let's hope this continues.

 I wonder if the banks will wake up and accept that they did in fact break the law 57/68. Then they,the banks will save themselves ever increasing legal costs.

Are the Spanish courts really so busy, my first hearing is in May 2015 that is over a year since taking action.  Maybe another year for second hearing, and another year for the bank to appeal.

By the time i get my deposit back it would have taken about 11 years since putting down my deposit.  I could have done something usefull with that money in that time. 

They are probably hoping we will die and go away before money has to be passed back to us.

I am confused, 

What is difference between 1st and 2nd hearing? Can someone explain?

My understanding is the first hearing is to see if the bank has a case to answer, once the judge rules they have the second date is set to hear the evidence.

The bank can then appeal after that if the ruling goes against them.

hi Jenno,

thanks for the update.  very pleased that it went well for you.  especially as my 'first hearing' is on 18 Dec!  i am with DWF in Manchester, like you we are taking action against BBVA and the hearing is also in one of the Alicante courts.

i think, perhaps, some of the misunderstanding some of us have with the process is on the terminology different people use to describe which court hearing does what.  seems sometimes the hearing which you have just had is called 'first hearing' and at other times it is known as the 'preliminary hearing'.  

got so confused that i was hoping the judge would be telling the bank to repay me my deposit next week!  now i have my thinking head on [as opposed to my hoping heart] i realise that the judge will simply decide if there is a case to be heard and set a date for it.  i think it is at that 'second hearing' when the decision about repayment of deposit should be made.

i'll let you all know how my .. hearing goes.

That's our worry, dying before it's all settled. We were to retire to spain in 2007, now 7 years later, having put most of our money into a new home, feel we have been duped. Would spanish buyers be waiting this long?
