Hi all...its been a while since my last posting.I contracted purchase of property at ACC in Sept 2005 through Parador,Aldea Resources etc and and paid the first 2 stage payments ' @ 70k euro approx by NOV 2005.
After several months harrassing Aldea they secured Bank Guarantee May 2006 for 1st stage payment.
I visited Aldea in July 2006 and got back the proceeds of second stage payment @ 25k which they had held on to themselves in view of emerging problems at ACC.-however 1st stage had been paid to HUMA and they were not returning it.
In March 2008 I requested Aldea to cash in my Bank Guarantee(BANKINTER) but it took them until 26th May 2006 to complete the paperwork relating to these instructions and my BG had expired on 25th May 2008.-one day late.
Subsequently Aldea advised that Bankinter were advising that BG had expired prior to receiving instructions from Aldea.and they would not refund proceeds.
Last year I transferred to a different lawyer who has been brilliant.He has responded immediatley to all my e-mails, entered into
fresh discussions with Bankinter and has today transferred total amount of 1st stage payment.He also got Bankinter to pay 50% of his legal fees which were 1800e.
I considered taking Bankinter to court to also get interest on above amount but all thing considered I decided to take the money and run.
If there anybody else still in the same position I was in and would like to know the name of the lawyer I used please PM & I will respond but certainly wish I had engaged him in the first instance instead of Aldea.If I now proceed with purchase of alternative property in Spain I will have great confidence in asking this lawyer to act for me.
