As I see matters the key facts are as follows:-

1. After this lenght of time why have Grant Thornton not seen the Company Spanish Bank accounts? As liquidators they should be entitled to a full disclosure of all Company bank accounts which I would have thought also included all international accounts especially as OVP was a spanish property investment Company. Without this crucial evidence its virtually impossible to prove who got what and all legal and criminal proceedings depend on evidence.

The questions that GT need to answer are

a. Why have the Spanish accounts not been forensically examined ?

b.Is there something legally preventing this being done?

c. What action if any are they currently taking to obtain full disclosure and are they involving the Spanish authorities?

My prediction is CT and his ring of advisers have done something to block or make access of the Spanish accounts as difficult as possible and that it will only eventually reveal the accounts have been bled dry with the only beneficaries as always being CT and hiis cronies.

What is now known is no less than £27m has gone through these accounts so GT need to ascertain exactly where its gone as a matter of urgency.

2. It must be clear to everyone concerned that this is an elaborate and sophisticated fraud that has been perpetrated and that CT and his various cronies have been consistently lying through their teeth for at least 3 years to delay matters for as long as possible in oder that the clients deposit funds could be effectively siphoned off or hidden.

They are all in this together and its only now that the proverbial XXXX is about to hit the fan that they are attemping to lay blame at each others door. One thing I do know is that CT by his actions must be in breach of his fiduciary responsibilities as the main Director of OVP. He has a legal duty to make sure that the company is run correctly and that clients funds are not utilised inappropriately. 

How does he therefore explain

a.There being no proper bank guarantees in place?

b.There being no adequate insurance cover?

c. Company funds being used (£1million no less) as deposits on commercial and residential properties that are not even owned by OVP and other other unspecified payments being made to enrich other unamed parties to the tune of up to another £1 million?

d.The sale contracts never being signed

e. Payments going to HIS antiques Company Blackbrook?

f. A payment of 4.1euro being allowed to go to Sean Woodhall before his untimely demise? A person he claims had no connection with OVP.

The whole thing stinks to high heaven and GT and the police including the serious fraud squad need to get their respective acts together as CT appears to be playing with them if the last report by GT of 13th Apr 2010 is anything to go by.

This is a very intelligent individual who has been planning this whole affair like a military operation with one aim in mind to fill his own pockets at the expense of the innocent investors who he probably looks on as a bunch of suckers. Just remember he has being cashing in everything he could for some time for example selling his letting operation Residential Lettings,putting Blackbrook into Administration and his most recent move to put Longdon Hall up for sale.

He would have you believe this is owned by his partner but everyone knows she has never had a thing to do with this property or the running of OVP. This is just another way of CTavoiding liability if the creditors coming knocking or there are ever any criminal compensation order .

If this were a boxing match Mr CT is currently well ahead on points and is it is an utter disgrace that he has been allowed to get away with the destruction of so many innocent victims lives.I am not confident given the performance of the police or GT todate he will every be brought to justice or made to pay for his actions.

I can only suggest that pressure be brought to bear on GT and the SFO by people going back to their MP's to raise concerns about the whole way this matter is being investigated. There needs to be a co-ordinated approach between GT and the police/SFO and communication needs to be significantly improved. Its only by all parties working together effectively that there will be any chance of recovery or the wrongdoers being punished. 

I wish you all well in your quest and just one final point is it not almost laughable that GT and Sun Golf would try and have everyone believe there were no legal documentation to set out the agreement reached between them which involved the movement arround of several millions of punds. This is an insult to people's intelligence and a sick joke bearing in mind the lenghty litigation OVP/CT had got involved previously with the developer Aifos.

I would be wary of this document. Is it authentic? Don't get too excited about this.

Grant Thornton should have access to the full records of the company and whatever is said should be able to examine the records to tell us where the money went. The flow of money through the Spanish Bank accounts is what needs examining.  Has anyone provided GT with any signed contracts yet?

Clearly OVP cannot be trusted.

Who knows if this letter has any substance other than Grant Thornton. If they finish the forensic analysis of the records (providing they can see the foreign records) they alone can tell us what happened with the money.

I refer to Isabella's posting on 3 May.  I have only just read having not been on the forum for a while...

Isabella makes some good points.  The point about CT being ahead of the pack is pretty emotive.  He may be clever, but he did have many advantages in his favour & playing for time to cover his tracks was one.

Another was us, his investors.  In my view, (& I may be wrong) we are all inadvertently helping him...

  • We are spread all round the country. 
  • We are a mixture of people of all ages from various backgrounds. 
  • All no doubt busy...

I could go on but hopefully you will see the point...

To stand a better chance of success (success = CT behind bars/suffering AND investors money returned) we need a small group of people that can co-ordinate information flow.  This would ensure the POLICE/SFO & GRANT THORNTON were supported to bring these people to book.  Joey123 has & continues to do what he can but I feel he needs support.

As we stand, we are 'divided' & sadly in danger of being 'conquered'

OR does such a group exist?

We are preparing a case on behalf of investors against whoever took the funds for the Estepona development and to that effect we are expecting to receive a report drawn up by the Spanish Police, in connection to the Operation Malaya investigations, where there is a list of all the transaction that took place between OVP, Estepona Beach and Country Club and companies in the Dominican Republic.

It important to note that a civil case here is no longer advisable as the mechanisms of this proposal are far to weak to be able to deal succesfully with the matter at stake.

Also, it is important to note that any legal action requires infrastructure and funds to finance it, as well as time, so that the destination of the funds each one of the persons who paid OVP for a property at the EBCC can be traced. We are at the moment working on it to be able to release important findings, but will require a bit more time.

This is the core of the question because it will determine who profited personally from the funds sent by hundreds of people. At the end of the day, if OVP people, EBCC or Miranda Miret received the funds, what did they do with them?

I suggest that we concentrate on Lawbird Legal Services dealing with this matter simply because we have more information than anyone else does at this point in time and will be obtaining, from lawyers acting within the Operation Malaya, the rest of the information we require.

Finally, I have a meeting with Grant Thornton at some point next week and will be, hopefully, providing them information they lack (and viceversa).

For those of you that are not aware, Colin Thomas was made bankrupt on 10 June 2010.

According to my source, Nick Wood of Grant Thornton was appointed trustee in bankruptcy which will only assist GT in their OVPI enquiries.

Another step forward.

Hopefully any funds paid away from OVPI to Colin Thomas can be traced into assets and realised for the benefit of the OVPI creditors.

Further to my post above, I have spoke to Samantha Locke at GT on a regular basis.

From what I have gathered and interpreted of our conversations, GT are pressing on with the claim against OVPI directors, employees and connected third parties.

Be aware that the claim is not likely to be settled or enforced in the upcoming months. GT will be working hard with their lawyers to ensure that the necessary proof is in place should the defendants choose to argue against the claim.

However, should GT be successful in the claim, the following will happen:

- Connected third parties and employees will be made bankrupt should they not be able to pay back the funds that they received from OVPI. I'm sure GT will work hard to be appointed as trustees in bankruptcy so that they continue their forensic investigation (as with Colin Thomas' bankruptcy).

- Connected third parties may be liquidated if they are unable to pay back the funds. This is likely to happen as most of the third parties are / were owned by ** EDITED - Names **. According to Companies' House, most of these companies do not have any liquid (or tangible) assets on their books. However, the liquidation of these companies will still benefit the OVPI creditors because it will complete the picture for GT and allow them to see where funds have been paid.

The whole Sungolf / Ricardo Miranda issue will not be solved in the next year or two. It will take alot of time for this to be cleared up, however, from GT's press release which was enclosed in our latest correspondence, it appears that they are making good progress with this. Im sure GT & their lawyers are still in contact with Miranda's lawyers and discussing whether an amicable resolution can be found. This is very doubtful but I'm sure GT will be compiling whatever evidence they have on Sungolf and passing this onto their lawyers to see if there is any case to be brought.

I have been monitoring this forum for some time. A number of creditors have made excellent contributions with valuable information.

For now, I believe it is best to wait for GT's next correspondence and continue to pursue any private action should you wish.

a thought - if anyone paid their reservation fee via a credit card you may be able to claim it back from the credit card company in the circumstances - I don't know if they took money via credit cards, but they probably did.

The GT annual update report should be out this week, apparently.
