Dear Fellow Purchaser,
 
We have all found ourselves in an awful position and many of us have quite rightly been very angry about this. Some of us have wanted to strike back at HdT and punish them for what has occurred. This is totally understandable but as a limited company the only ones that would be harmed if SADM does not go ahead are your fellow purchasers.
 
We have met many of these purchasers at the HdT meetings, we have spoken to them and to others on the ‘phone and they are all desperate to save their money. These are real people, they could be your neighbour, they could be anyone and they are all decent hard working people who will lose their money if not enough purchasers accept the agreement.
 
 We are not making this up, this is the brutal truth, these people have done all they can to save their money. Some have taken out second mortgages or put down their life savings and are in their 60’s and will not be able to replace the loss. These people need for all of us to think very hard about the agreement and the impact it will have if we fail to sign up and save them and ourselves.
 
We also ask that you consider carefully any advice that does not warn of the high risk of losing your money if the agreement is not accepted. We were all given advice prior to getting into this mess and it has only been us purchasers’, who have suffered and it is only our money that is at risk.
 
Every one of you is important and it could be your acceptance of the agreement that saves the day and the money that we all have in jeopardy. We are close to getting the amount of votes needed but truly need you to help and hope that you will do so before it is too late.

Once again Tony we have not somehow woke up one morning and FOUND ourselves in this awful position we have been put there by HDT.

My terms of voting yes were quite simple.

Issue me with a bank guarantee and i will vote YES no bg no vote.

Once bitten twice shy.

Almudena is issuing bank gaurantees have a look at her response in this weeks Costa Blanca News page 5 believe that and you will believe owt

Make no mistake, HDT have no intention of returning any money to us purchasers, even if HDT obtain enough YES votes to continue trading they will do nothing different to their hitherto standards of customer care or satisfaction.

They are unable to obtain bank guarantees despite claims to the contrary for if they could they would be          " waving the banner " with bank guarantees for all to see.

We received two telphone calls from HDT last week , the first contact from them in almost four years !! The sole purpose of their contact on both occasions was to persude us to vote in favour of the proposal and BLAME US if HDT go into liquidation.

Suffice to say they wont telephone us again. !!

my opinion is that they only want to save themselves they must have an awful lot of assets more than anyone will know and if they go bang they will loose the lot that,s why they are hassling everyone if they had nowt would they care i think not

totally agree !! they are all crooks. They should be sent to prison and left to rot in my opinion, or better still lined up so we can torture them like they have us for the last 5 years.  They have broke the law 1st not issueing bank guarantees 2nd Not keeping purchases deposits in a 'ring fenced bank account' .

Instead they used our deposits to fund their lavish life styles transferring money illegally, and they still want us to vote YES. They are off their head.

 

Lets just say i am looking forward to meeting up with them when they come to Newcastle on the 21st May !!!!!!!!!!

We are all being kept on tenterhooks, while waiting for an important decision - no, not whether it will be a Tory/Lib-Dem pact or Labour/Lib-Dem pact! - but whether HdT will get enough votes to continue.  I wonder who is the most nervous: Gordon or Almudena? 

Anyway, joking apart,  I have decided to copy María´s post from the general forum below, as it may be of interest to people on this forum.

Legal tip 270.Campaign to pressure on Banks and Savings Banks 

 

What about a campaign for putting pressure on  Financial Institutions to pay off in those cases where they failed to secure on the existence of Bank Guarantees/Insurance policies for off-plan buyers?

 

When a Bank Guarantee was not produced for the buyer, the only resort os to go against the developer: this is resulting in very costly and long judicial procedures with a big battle at the end, in order to enforce a Court Decission and obtain the funds back. Many developers are now very short of funds in Spain.

 

If Banks where your money was deposited can show they made all possible for the existence of the Bank Guaranteess, then, just conveyancers and developers will be liable for the missing of it.  

 

But if they cannot prove it, they are liable.

 

Someone needs to respond for this disaster and the first ones to ask about are Financial Institutions:  Banks were officially and legally entrusted by Law 57/68 to custody off plan purchasers´funds.

A big battle and a reunion of efforts is needed here, we are concerned they were long-life savings for many of you.

Who is joining o us regarding this? Before starting the judicial battle, we are sending a communication to Bank of Spain in order to have them  issuing an express  statement  on liabilities of Banks on this particular point: please email us if you are in that situation so we can join your name to the efforts.

Dear All,

Those of you who have had your money back via your BG should have the decency to refrain from making snide remarks.

As for those of us who donot have BG's ,I fully understand the anger of some and the desire to punish HdT .However, I must point out that  I am a fellow purchaser and belong to a group that has grown even larger over the last few weeks. We want to save our money, we have members who despite being very angry with HdT, donot wish to throw their money away.

It may be that some of you, for what ever reason you may have, believe that throwing your money away punishes HdT & is your prefered option .Well I respect your right to choose what to do with your money, even though I feel it is a bizzare action to take. However, I do not respect your behaviour in attempting to get ALL purchasers to lose their money just because you are angry.

I suggest that a quick dose of reality and rational thought would not go amiss, particularly in the light of the economic fall out from the fiasco in Greece.  Do you really want to lose you money? Will you be able to look some one in the face and tell them that you did all you could to lose their money & that you are happy with the outcome?  I strongly suggest attending the meetings being held in Newcastle  Friday 22 ,Birmigham  Saturday23 & London  Sunday 24 in 2 weeks time and see if you still want to throw yours and every one elses money away. 

I am & will continue to liaise with members and any purchaser to try to ensure that no one loses their money and that even includes those of you who appear to fail to understand that you will gain nothing from HdT being liquidated.

Tony,

              You probably dont recognise my name on the forum as I have not posted for several months. I like many others put down the deposit a considerable time ago and from day one was constantly "promised" a bank gaurantee.

At no time in the lead up to San Jose (Hdt) problems did any one from the company contact me to inform us of the situation, likewise once the news had broke no one from the company offered any explanation or had the decency to give us any information.

In short the company have broken the law and are criminals.

Only now that the company want something are they in contact with me.

I cannot for the life of me understand why you remain loyal to such a company, if you had been sold a car from a car dealer who had broken the law and mislead you at every opportunity would you go back and attempt to buy a second car?

I also find your support of extending the deadline unethical and selfish. The conditions and problems re travel have been the same for those voting "Yes" and those voting "No", it was a level playing field and not biased to either group of voters, the deadline should have stuck. The extention is a result of the company having a panic attack, all of a sudden they wish to speak with us!!!

I travel to Spain on a regular basis and speak with other builders, San Jose do not have a good reputation and the opinion of the people I have spoken to who are in the building trade in Spain cannot believe that ther are people still wishing to deal with the company or considering the proposal.

I will not be responding to any reply you issue as I am of the opinion that you must have some other agenda.

Could you please answer this very simple question (a YEs or NO will suffice).

If we go to the meeting and agree to vote YES and agree to carry on with our purchase will be get a bank guarentee?

I think you may find they will answer yes to get your vote and your bank guarantee will be issued in a couple of weeks. Then after a couple of weeks there will be a delay due to the ash cloud then after that it will be a national holiday then next it will be an adminastrive error and so on. My point is you can not trust anything they say and i do not think many will argue that they are not dishonest, unlawfull and crooked. What really annoys me is the so called Spanish justice system which allows these companys to get away with it, it is okay posters and even solicitors quoting laws and regulations in place to protect us but if there is no justice system to inforce them what good are they to anybody ?

Hi Willsb,

I can not speak on behalf of HdT and have not done so on any occasion. All I can say in response to your question, which has been asked by others at the past meetings is that in last weeks Costa Blanca News HdT stated that we would be given BG's.

I suggest attending a meeting and asking the question directly rather than relying on the EOS forum.

What they say is irrelevant because we ALL know they cannot be trusted to do what they say they will do even if some will not admit it. They failed to issue them first time around so why should this time be any different???. And do not say because the courts will be watching them and will punish them if they do not comply because the courts cannot be relied upon and trusted either.

Ken,

If you wish to play ostrich and stick your head in the sand, that is your choice but it is very silly. I suggest you take a deep breath, cut out the paranoia and start to think rationaly. What do you have to lose from going to a meeting, listening, asking questions & even meeting other purcahsers? 

I suggest that rather than throwing daft accusations around people get up from their PC's and go to a meeting and engage in the process and then decide what to do.  Kindly stop ranting at me, I am a fellow purchaser, who is doing all possible to prevent those of us without BG's loosing our money.

Thanks for the reply, I am going to email them and ask them to bring along my bank guarentee to the birmingham event, if they do then I will consider a yes vote, if not a definate no and I would recomend others do the same as this.

I think you will find someone who burys their head in the sand refuses to admit the crap they are in and pretend everything is going to be ok. (sound like anybody you know ?)

Rather than burying my head in the sand i admit the fact we have been screwed by HDT and will probably be screwed by the justice system also.

I was under the impression that paranoia was imagining you were in trouble when in fact you aren't, well heres hoping i am paranoid.

Please state the daft accusations that you refer to.

Why do you still refer to everybody as purchasers when we are in fact creditors ?

Good luck willsb, guess that's another no vote then.

We have 2 very simple choices:  Save your money or not.

 So Willsb , I suggest that prior to you deciding to throw your money away you avail yourself with as much information as you can get. If you attend the meetings you can ask your questions in person and get your reply there and then. Why do you not wish to do this?  If you genuinely want an answer go to a meeting.
