Dear all,

              We would just like everyone to know that we have received our deposit back from the bank, by cheque, after having an out of date bank guarantee.Originally, we were ill informed that as our BG was out of date we would lose our deposit if we pulled out of purchasing. However Costaluz Lawyers were recomended to us. It took quite a while, but we were informed of proceedings every step of the way, and they successfully won our case. We have received our full deposit back. Costs and interest are to be returned at a later date. So thankyou very much to Maria de Castro and her team, especially Steven Schaffer, who dealt with us, also we would like to thank Diane and Richard who recommended Maria to us in the first place. For everyone who went ahead with their purcase, we wish them all the best and many happy years in San Juan.

Hi Suemark,

 

Congratulations on your great news.  We are presently trying to get our own deposit back and our solicitor is taking the builder to court.  Would we be right in saying that you were successful in getting your deposit back via the bank guarantee route, as like yours ours was expired also.  Only because we were unable to renew it. 

 

We would greatly appreciate a response as we are sure you will be inundated with emails on this subject.

Hi Danny & Geraldine

We too are currently in the midst of legal proceedings with Peinsa.  We first instructed our solicitors in 2008 for a property we paid a large deposit on in Calas Del Pinar.  We have subsequently been informed by the developers that our property will not be finished.  This is due to twice as many properties being built on the land as originally agreed on the plans.  We have spend out life savings on this white elephant and still paying regular amounts to our solicitors in attempts to recover our deposit.  We were offered another property by the developers but this was half the size of the one we purchased but they wanted the same price for it and would not budge on this.  We turned it down and instructed solicitors which is where we are currently at.  It is good to hear that Sue & Mark have been successful in recovering their deposit, it gives us all hope.
