Having read the latest report it amazes me that tony can not be at all worried that almundena et al did not have the savvy to realise that the judge may actually want to see the director of the company or is that more delaying tactics, but is pleased that they are standing by with labels at the ready to post out the report (hope they put a stamp on it).

I don't whish to be rude but they could'nt organise a piss up in a brewery, i have said it before not once an apology for all this shambolic crap. God help anyone who wishes to continue with the construction.

One last question for tony, with out names how many members are there really of SARC, and when you have discussions with almundena and co, have you told her  how many wish to continue. Becuase it seems to me the majority of people on this forum do not want to continue. We too stand to loose a lot of money but i am sure not going to chuck any more money down the drain.

I believe you are leading SJ/HdT to believe that purchasers want their properties at any price .I believe that you have diminished the possibility of a good outcome for all  !!!!!!

Telephone communication between Anthony Malpass, on behalf of the SARC membership and Almudena has been taking place since the last report. On the 18th February there were two further discussions: When are you going to realise that Almu is working for SJ/HdT and is trying to protect her family buisiness  and not purchasers .The two do not necessarily go hand in hand !
 
Settlement Agreement
 
Almudena spoke to the Court on the 17th February and was told that the judge wanted her brother (HdT Director) to attend the court on Friday 19th February to sign & ratify the agreement. Not rocket science did she not understand the judge would want the director to sign this off .Pure ametuers !!!!!! This is just more waffle and as usual Tony falls for it !!! 
 Why are you not asking the questions that matter Tony !!!!
She also stated that the translation of the offer was completed, that the HdT website was ready for the documents to be uploaded but they needed to wait for the courts’ release of the agreement offer. Hard to believe when many have already seen the agreement !!!!! Notice that she avoids discussing the content of the agreement !!!!!!
 
 Some waffle to avoid the real issues / come on Tony get real !!!!!!
Envelopes are labelled and letters written awaiting posting to purchasers/creditors to inform of the HdT website, settlement offer and the proposed UK HdT purchaser/creditor meetings. It is anticipated that the letters will commence being sent out next Wednesday Well blow me the SJ/HdT admin  deparment are actually capable of doing a mail run and addressing envelopes .Whooopeedoo ! perhaps they should have used these advanced business skills to keep purchasers informed or to apologise over the last few years .I doubt this will go smoothly !!!!!!
 
Almudena was surprised that some solicitors appear to have copies of the agreement & was concerned that there could be misinterpretation of its content. Perhaps she was more concerned about purchasers getting the true facts as they really are and not as they are according to SJ/HdT and SARC Almudena was asked about a comment by a solicitor that appeared to state that purchasers would have to pay for their property before its completion. It was explained that this is not the case for those of us who are already purchasers Total crap Tony I hope you got this in writing !!!!!!!!!   but that there may be a different payment schedule for future purchasers.
 
 It is important to note that the time frames put in place are the worst case scenario and are done so to prevent HdT breaching the time lines in the agreement. Well lets go on past experience Tony what ever SJ/HdT say we can add on at least  5 years so lets not go there !!!!!  If the time lines are breached HdT can be taken back to court and liquidated. Therefore, it was explained that the build may occur earlier I doubt it !!!! and the repayments  could also occur earlier I doubt this !!!! they will drag them out as long as they can !!!!!   than stated but the agreement has the non breachable deadline time frame.
 
As soon as we receive a copy of the agreement in English and Spanish, we will send them to a Spanish Barrister  Which  Spanish Barrister would that be ????? ? I have long since thought your Spanish barrister is not entirely independant but that suits SJ/HdT hey Tony !!!!!   and ask for an opinion that we will share with the SARC membership and other purchasers.
 (should  this section not be in Opinion/Comment  as many will want their own legals to look over the document as it stands and will not want to recieve it via your barrister ) Just to be clear  .The document will be circulated by SJ/HdT  to the SARC membership via your  barrister   !!!!!!!  Many purchasers  remain unconvinced that SJ/HdT are not paying for your barrister or that he is totally independant . Please Tony Get real  !!!!  .
Jumilla Town Hall.
 
The Jumilla Town council has commenced action in the court in Madrid and the court is considering annulling its previous ruling. Furthermore, HdT presented a water certificate to the court 2 weeks ago and have been asked to supply a further document, which they anticipate having shortly. The Town hall is supporting SADM. Considering Tony only considering by no way a sure thing !!!!! and seen in legal circles as highly unlikely !!!!!! 
 
HdT Eire / UK meetings
 
It is still planned to have meetings in the UK and it is probable that they will be around late March early April. It has been suggested that those on the UK mainland will be in Manchester, Birmingham & London. There should be confirmation of the dates & locations either in the letter being sent out or on the HdT website.
If SJ/HdT are footing the bill for this it is highly unlikely !!!!!
 
 
 
HdT Website
 
HdT are getting ready to go live with the website. SARC anticipate having a web link to the site and will inform members as soon as we are informed that the HdT site is functional. Same if SJ/HdT are paying for this don't hold your breath !!
 
Comment / Opinion
 
As the settlement offer will be available for all to read next week it would be prudent to ignore any apparent partial release of its content and a wait being able to see it all in context. It may not be ideal but it is the opinion of the SARC executive that it is better that we come out of this mess with something rather than a total loss. Those of us without bank guarantees can ill afford the company to be liquidated, despite a few who have BG’s and suggested such an action. We urge all purchasers to act calmly and seek a positive resolution to the situation. Total tosh and speculation spun by SJ/HdT what are you getting in return Tony must be good !!!!!!

 

MM's comment this is nothing new just SARC spinning on behalf of SJ who knows why !!!  Lets just wait and read the agreement  .Just make sure you have the correct copy,  there are a few going around !!!!!!!! MM

I find it strange Tony that you are unable to give figures (NOT DETAILS ) of the numbers who are SARC members .It is clear to me that you are over estimating the SARC membership and that this is having an impact on the deal being offered by SJ/HdT .I believe you are leading SJ/HdT to believe that purchasers want their properties at any price .I believe that you have diminished the possibility of a good outcome for all  !!!!!!

If you dont vote for the company to go into Liquidation you should expect nothing why should things change now it will have taken em 2 years to make an offer,why cos they have had time to move assets remember HDT/SJ have never been upfront with anyone so you shall receive nothing

Due to illness there is a delay in loading the report onto the SARC website, so I am posting it below. A further update will be out within the next few days and will contain important information for all.

February 2010 Report

Settlement Agreement
