Thanks Brianmag very pretty pictures of poured concrete. Which is all that is actually on the ground. I know I was there last week. There is no infastructure ie. roads, drainage, street lighting, pavements, green areas, pedisrtian crossing points, childrens play areas, trees, golf course landscaping, kerbs, electricity power boxes for each property, water points, fire hydrants etc. etc. These are all the requirements  to be built under the first licence isssued. Which is the way licences are granted in Spain. that is why where ever you go in Spain you will come across roads, street lights, etc. but no houses, because that is what should be built first.

Has that occured at Santa Ana Del Monte, Jumilla? No it hasn't. the pouring of concrete into holes in the ground was a quick fix to apease and dupe the people who had purchased there and went to visit. I know I was one of those fooled into thinking Oh good my foundations are in , wont be long now!! how wrong I was. I even dismissed people like FIN who regularily posted that it was all a con. was he right I'm afraid he was.

Look around at all the other developments in Spain, the infrastructure is always, always built first but not at Jumilla. Why? because they conned us all. Can you  not see it?

In my opinion, humble though it is, Jumilla will never be built by San Jose or any other company. It is just not economically viable, insufficent people would buy there, its in the middle of nowhere, rental potential nil. future Nil.

Evening Dave,

I totally agree with all you say .

Yes FIN was right and tried to get people to listen  for years he could not always say what he wanted to out right but if you researched in the many directions that he pointed to in his posts it was quite easy to see that he was right . he never gave up trying to let people know the truth that he was aware of all along.

It infuriated him that others could not see what he knew to be fact .Unfortunately he was not in a position to divulge the ins and outs of his situation and why he could be 100% sure of what he knew about SJ/HdT and SADM   , he knew exactly  what was going on all along.

I never dismissed what he said and realised he was right long ago .I can not imagine the frustration he felt when people refused to listen year after year and worse continued to defend and support the SJ group and their actions in regards to HdT and SADM  , this may be why he sometimes seemed a little rude and abrupt but he truly wanted people to look into the facts for themselves .

I know  like you Dave and anyone with a modicum of intelligence  that it was all a con and the scummy little deal they are offering now is also a con . SADM is as many have and continue to call  it  the ultimate " elefante Blanco " .MM

Just a thought  Dave, if you are prepared to let by gones be by gones regards both FIN and I arguing with you regards  your property /deposit transfer deal thing   .

I would really like to discuss with you by PM the implications of the real situation as we now  know it to be and the implications for all purchasers involved .

If  you are up to a discussion (brain storming exchange ) No catches and I promise that we will only discuss the following points  .

1)   What can we expect given the reality and influence of the current situation for those with  SJ/HdT  BGs issued by  the various banks / insurance companies that provided SJ  BGs   .

2)  Which bank  insurance companies are paying and which are not ? What reasons are they giving for not paying  and why ?

3) What  is the success rate on pay outs to date on  the BGs issued on behalf of SJ/HdT from the various banks/insurance companies  ? 

4) What is the most successful legal route and in which order should things be done to increase the chance success   ? 

5)  Which order is getting the best results  ? (there seems to be more than one way and the sequence seems to be important in successes ) ps I have been listing and evaluating the key points on all cases of a successful outcome  I can find .

 6) Are  some lawyers getting results while others are not ,why ?

I have been taking notes for some time regards success and failure of BGs looking at all the relevant points  and I  see a pattern emerging ! 

I would also like to have the lawyers who contribute on the forum ie Maria ,Martin ,Lawbird etc give their opinion on the SJ situation regards the legalities of the latest  HdT proposals that have been fed through to us via  SARC .

I am unable to send or receive PMs at the moment  but hopefully this will change soon and we can  all discuss .MM

My reasons for suggesting we discuss this via PM is  that some purchasers  may not be interested  in some  parts of the discussion but who knows it may  throw some light on the bigger  questions and  issues  that all  purchasers have . I do feel that the issues are all intrinsically linked .

What do you all  think ?

ps I notice that  all posts so far have been negative re the latest  HdT proposal  put  forward by SARC .

Not one single  SARC  member  has posted in support  except Tony and Brian . This is very strange as  now that FIN is banned and everyone else is being very polite ,courteous and considerate  to all views .I would have thought there would have been a rush of support  for SARC  and the proposal ! No problem discussing anything with anybody. Prefer it on an open forum rather than PM as my views are if people don't want to read the post they can always scroll on. However that is irrelevant as you are unable to PM at the moment. When you can I will of course reply to all PM's that I receive. I only stop discussions when they get abusive or personal acts on me, my business or my family.

Regarding BG's the only information I have about paying out is the friends I've made who have executed their bank guarantees all are from SGR.  I do know of one payout from Banco Pastor. SGR have paid out on all that have cancelled their contract with San Jose and the cancellation has been verified by the administartors and the judge. Almost all of them have also claimed interest back and successfully. That is what we are waiting for, SGR's response to our demand that they pay interest as per the law. we are happy to have them pay it now or take them to court for the interest.

My BG even had an expiry date on it and originaly I was told by my solicitor that it wasn't worth the paper it was printed on. This I refused to accept and continued to seek clarification, eventually I was informed from the Supreme Court in Madrid that the law states that bank guarantees are valid from date of issue until Habitation Licence is issued regardless of dates on the BG. I then had to wait for this to be challeged in the courts, which it was this year and the judgement made it quite clear that BG's are to be paid out with date or not.

Next problem was trying to get San Jose to cancel my contract. This they refused to do because they kept saying but your house will be built. Just another delaying tactic by them as they wanted all purchasers to remain on the books as it then seemed as if SantaAna was still a viable project when they were discussing it with "backers". However as we had one of their assets that they were desperate to sell ie. an apartment in La Zenia, suddenly they couldn't cancel our contract soon enough. Actions of a trust worthy company I think and know not.

Hope this answers some points. I'll have a think about the others

Hi Dave .

Thanks for the reply ,as you say there is no reason to discuss via PM  as I also agree it is best if all facts are out  in the open forum for everyone to see .I just don't want the SARC all is well scenario coming in and ruining decent debate as it is boring me now and non productive .

I have to disagree with you as to the paying of BGs by SGR they seem to be very sporadic in paying out with no rhyme or reason as to the whys and wherefores when they do or do not pay .  Have you researched SGR  ?

If the law 57/68 is being applied then the results should be far more consistent what ever the circumstances .The crucial thing the courts and the banks seem to be taking into account  is weather the  property is likely  to be built or not a situation which is not good where developers like SJ are not truthful and also irrelevant given the time we have waited .

There are many other things to be discussed  regards the whole  SJ/HdT situation and how it affects  all of us involved.

I can confirm Dave's information regarding BG's with SGR as being correct .My BG with SGR was honoured and I received full refund back in August this year. Resolution of my contract had to be obtained first and rubber stamped by the Judge. Anybody who follows this route with the assistance of a  reputable Spanish lawyer should have no problem. With the excellent exchange rates (euro/pound ) in my favour I came out of this nighmare 'smelling of roses.'

Hi Taxi nice to hear from you again . The reason I am trying to get some discussion going on this is because my BG is  also with SGR and I don't seem to be having any joy at all .Have done everything suggested but still no joy . I am baffled . Cheers MM

Hi Magi,

Have you obtained resolution of your contract and has the Judge accepted it ?

If so then what is the bank saying for not complying to the courts  ruling/decision ?

Is your BG for El Pinet if so that may be your problem, I had a pm from someone who had a BG and was buying at El Pinet they too have been refused payment I dont know why it is different but

All the people I know  who have been paid out had a property at SADM and the contract have beeen resolved and signed by the judge beforeexecution of  BG

Hi taxi , yes I have had my contract resolved and have a court ruling .I can not seem to get an answer as to why SGR are not accepting the ruling .

I know someone else who has the same bg as MM and been through the same process and is still waiting over 2 years for the bank to pay out.

Can the bank be taken back to court or is it possible that they have paid out and the money is in the lawyer's bank account earning interest, just a thought!
