It really annoys me that Huma have some of my money. I understand that many of you have "lost" more money than me.

However, this is for the "lucky ones" that have just not received their deposit or interest back from Huma after cashing in BGs etc.

Is there anyway we could collectively join forces and take Huma to court to get our money back? There must be many like myself who count themselves lucky that they got out when we did but the other side of the coin is that Huma are still laughing all the way to the bank with our money.

How many do we think are in the same situation as myself? Probabaly hundreds so is it possible to do something? Surely a group action - giving the numbers - would not cost much. Or again is there anyone willing to take this on for a percentage of each of our deposits?

Food for thought. I welcome any views.

we successfully recovered our BGs through Victor at Mam solicitors, and at the time he mentioned that individually it wasn't worth going after the deposit or interest etc as Huma wasn't paying out court actions at that time, so even if we won we probably wouldn't get anything actually paid to us. He did say if things change and he had a number of clients chasing the deposits/interest/compensation, then he will consider starting such action. Having not heard from him in over 8 months, I am presuming his judgement of recovering monies has not change.

If a group action is started, let me know.

Is there no good news coming out of ACC at all?

Is no-one getting any money back now at all?

If they atart building at ACC - doubtful at the moment - but in a few years do we who are owed our deposits still own part of the plot that the deposit covered?

Very depressing...........

Good question.

I think it's really the last remaining hope we can cling to. And that is, when, (if ever) they start up the ACC building that we all make it extremely difficult for the developer to re sell propertries that have deposits / buyers linked to them. So that will be quite a few plots I would guess as very few buyers have had any deposit returned. Also, I believe it is illegal in Spain to sell a property with outstanding debt against it and that the debt would transfer to new buyers !!! 

BEWARE NEW BUYERS ON ACC. YOU COULD BE LIABLE TO REFUND OUR DEPOSITS IF THE PLOT / PROPERTY YOU BUY HAS AN UN REFUNDED DEPOSIT AGAINST THE DEVELOPER........................

This developer needs to think this one out carefully and the best way to clear this mess up is to refund original buyers their deposit. -  NOW.

I dont think there is much chance of that.  If ACC ever gets of the ground then you may get your deposits back just before they sell the properties on.  What happens though if HUMA goes bust and another developer takes ACC on.  Do they have to pay the deposits back or are the deposits just a liability of HUMA?

One thought is to get your solicitor to ensure title of the plot that we have all paid our deposits on is now held in your names and then you just wait till a further search of title is carried out in the future and then you will be in a much stronger position to get your refund!

If however the new purchasers solicitor was as good as the one we had then you sit back and wait till the property is built then instruct a good solicitor to seeze title on your behalf!
