Just out of interest has everyone paid there entire outstanding SUMA bill to Elche council?

I have and I know quite a few of my immediate neighbours have, this is definately a legal requirement and must be paid regardless of whether Habitation Certificates are issued and it is backdated to when you exchanged contracts with the builder.

I wonder how many owners, residents or non residents have met this legal requirement? Elche council may feel an obligation if everyone was fully paid up (perhaps I'm just becoming naive also!)

I'm a non resident, who no longer uses his El Pinet property at all, however I fully meet ALL my legal obligations.................the so called 'community' and their fees are totally illegal and mis-guided.

Elche council, the builder and the utility companies will sort it out eventually, as it's in their best interests, the rest of the noise is just confetti.................................

Totally agree DI. It in the councils interest and Iberdrola to get us connected. We are potential customers.

If sj are coming back, they will need to start payig their bills.  Please all, hang on, dont be afraid, if what is being said is true, you will have your own meter soon and wont be asked to pay sj's debt.
 

From what I am hearing I am wondering who is running what show.....still all illegal, remember that it was agreed.

Today I have been told that there were suggestions from the floor that were dismissed by the  'administrators'. It will be interesting to see if these were minuted. When we do get a proper elected committee for our properly formed community then we need a 'constitution' detailing what exactly, without contradiction the committee can do. Their powers need to be very very small, and if a major spend is proposed , everybody, yes everybody votes. We also need to keep each section independent.

Can anyone who attended the AGM tell me and others if these matter were discussed?

 It was decided that legal action be taken against San Jose and Iberdrola pending an agreement from owners at the AGM.

Francisco Llopis is to arrange for a meeting with the Ombudsman to set out our present concerns and grievances.

Alec Aspden is to make contact with the Deputation for Foreign Residents in Alicante to see what help, guidance or advice, if any, we can expect from them.

We will also make an approach to the local press to outline the situation here on site.

Ascertain exactly what is still required from San Jose or others in order for Habitation Certificates to be applied for. (depending on San Jose circumstances over the next few days it is possible we may have to undertake this ourselves!).

N.B.

The EP administrators are there just to administor nothing more nothing less. They don't run the show, its down to the President/s and commitee's to run the show. Thats if we look on these people as being legal?

I was looking through some old bits of paper today and found the 'minutes' to the first committee meeting in Dec 2008. They suggested a  €20 fee to form a constitution.    mmmm.... not done.  Someone decided a community should be formed. These people were not given the authority by us to do that,

Have received the following information which no doubt will be available to all shortly.

Position regarding payment of bills was explained at the AGM and apart from one or two dissenters was accepted as inevitable until we receive individuel meters.

All dissenters are welcome to come on board if they think they can help solve the problems.(Bet we don't get too many takers as most prefer to whinge and snipe from the sidelines) We all want to see an end to this saga.

The proposal to increase charges was made initially for 6 months to pay a back log of bills and ongoing bills. It was felt that it will assist negotiations with Ibedrola on any future decisions with regard to cut offs.The Committe/Administrator are now dealing with Ibedrola on a much more frequent basis. The Presidents and Administrator also now have power of attorney to pursue debtors  throughout 2010 then back a further year.

San Jose were due to sign contracts with Ibedrola, this week?,  to enable the outstanding electricity works to go ahead in 6 - 8 weeks. If this does happen we will be in a far better position to push for Habitation Certificates.Elche have also released some of the monies deposited with them by San Jose as a bond, in order to progress the electric works and the continuation of M1 Apartments. San Jose are due back on site soon to begin. Fingers crossed.

Just heard  that electricians are on site today carrying out some sort of tests.Power has gone off at different times in different locations but is now back on. Hopefully there is some light at the end of the tunnel.

Whos bills are you expecting us to pay. I am confused by what you believe to be 'power of attorney'.

As for 'dissenters'...about 3/4 of the people who own property on the estate are barred from having a say if they wished ( but as they know the whole set up is illegal they don't want to be involved), 

Any date chosen so far for any 'informal meetings' have been at a time when those living there have expected us to be at work earning so that we can pay their bills. After all when I am here, I am not using there, BUT someone is and I have NO responsibility whatsoever for that consumption.

Thank you Victor for speaking for all us so called dissenters. I have read all the posts for a long time and only wish that more people knew about this forum. .People feel alone and vunerable when bullying tactics and threats are used. Power goes to some people's heads given the opportunity. I hope the situation will be resolved soon but........I will hold my breath and stand firm until I can live in el Pinet in peace and enjoy the fruits of my continuing labour.

Read latest ' committee' meeting post on El pinet web site. These people DO NOT represent me. Never have, never will. The pools are  STILL  SJ'S. They need to make sure that they are ' FIT FOR PURPOSE' when they are handed over.

RE: Bank Charges. Who opens an account of any type without finding out FIRST!

70% OF RESIDENTS TO BE PERSECUTED...OOPS PROSECUTED, GET REAL!

Just seen the El Pinet web site. Why don't they post the minutes of the meeting for the majority of those who couldn't attend.

This is a far as I am aware a free site not so called dissenters as some say. But people for and against to make comment.

What ever happened to free speech, that is everbody resident and non resident.

And when we do get a proper ' committee' after CoH, the elected area committee will represent all IN THEIR OWN LITTLE COMMUNITY. It wont be just those living there and SJ.

I have waited patiently since my last post on the 9th Jan for a reply in relation to who has the keys to the service cupboards.  Lorkil was quick to reply to my post.  He introduced himself as Mick who lives at number 76 (please note this for your own future reference).  He is now on the committee of our apartment blocks.  His answer was in repy to my post but did not reply to who was the key holder to the service cupboards.  For information only his wife was previously on the committee and would have knowledge or access to the keys of these cupboards.  He conveniently side-stepped and made no referral in his reply to who has the keys to the service cupboards.  My enquiries at the site have established that in fact he has access to these keys and is the self appointed vigilante of the El Pinet site, even though I remind him that the adminstrators stated that "no-one has the right to disconnect any resident from services at the site," for him this obviously fell on deaf ears.  Mick your position as a representative is untenable and you need to resign and disassociate yourself forever from representing the residents of the El Pinet apartments.

I am informed that it takes at least 4 years to take debtors through the Spanish courts, so any hope of the residents who are creating the bills having any resolution to their financial dilema is ill-conceived.  As I have stated many times in the past, my legal advice is that any action against non-payers to an illegal community will not succeed in the courts.  The only people that will benefit from this kind of action will be the administrators.  They will take their costs and their in-house solicitors costs up front before any other bills are paid.  If the residents  of El Pinet want to give the administraors power of attorney to spend their money without any hope of success then so be it.  Surely a statement from  the administrators as to the estimated costs of the proposed action against debtors should be sought and be available to all as a matter of record.  Also the legal advice in relation to this action should be available including the legal propsect of how successful any legal action is liable to be.  My point is that the administrators  will proceed regardless of the cost as to them its work which will be paid, even though they know  there is no possibilty of an action  against debtors being  successful.  They do not care as it will just fill their pockets with the money of the El Pinet community.

There is a 'universal key' available in most of our cupboards.  A hammer! More accurate if you use a chisel as well.

Please do get your facts right before posting on this forum M2Lou. I am not "Mick " as you state but I am his wife and I am not and have never been on the committee.  My husband is on the committee this year but he does not have and has never had any keys to the water cupboards.  Someone did say that San Jose put locks on these cupboards and have the keys but this not an un disputed fact.

 

And in case there should be any other rumours going around on this "forum" We were not even here on the date that the person stated his water was turned off, we had already gone back to the UK for Christmas.

Once again you have posted insults of a personal nature on here without having the courage to do it under your own identity.  No wonder the committee has distanced itself from this forum.  I myself only post on here when people like you get your facts wrong.

Freedom of speech is the right of everyone but has to be challenged when it sinks to personal insults for someone to have their voice heard.

Freedom of speech is a wonderful thing.  Read the comments on the el Pinet site home page and you would understand that there are those who only want us to do what the committee wants and anything else is not sanctioned by them.

Maybe wrong use of the word or not!!!!!!!!!!!!

Well I have never been 'personal' but will continue to speak my mind. I don't know who posted the piece on the EP home page. But they do need to look up 'sanctioned'. Who do THEY  think they are even to have the thought of sanctioning free speech and thought. May be a more suitable place to live for him / her  would be North Korea.

As for in Europe, millions gave their lives to protect that right.

Remember: When we get our CoH and everything is  legal, we  can ELECT a committee for each area will truly  represent ALL OUR INTERESTS in a fair way and yes decisions will be group ones, not ones made on the whim of a self appointed few.

It was good for Lorkil to reply so promptly after such a long silence.  Madam, your husband should tell you when he uses eye on spain, as pointed out elsewhere, he does introduce himself as Mick from 76. 

I was not aware of yet another resident being victimised by your husband by cutting off their water.  My information came from sitting within earshot of you both while you had coffee with others,  so it is not a rumour but a matter of fact that came direct from the source.

You are absolutely right M2Lou about my husband introducing himself (nothing to hide you see! unlike yourself).  If you really must sneak around listening into other peoples conversations you would know that it was after 1st January when we returned from UK and what we were discussing was the posting by "PatandLinda" saying that someone had cut his water on 20th December at which time we were not here.

As far as I know, nobody else has said that their water has been turned off.  If you know otherwise, why don't you make your allegations out in the open in your own name!  But then I think that listening in on other peoples conversations is more your style!

As for the posts earlier in the month, the first one was by meTHE WIFE. The second by him THE HUSBAND. We are married, we share a laptop!!

Notice you have said nothing about mistakenly stating that I was on the committee or about wrongly stating that we know where the keys to the water cupboards are kept. If you make false allegations you need to be able to back them up!

I first became aware of direct action being taken against non-paying residents whilst attending the AGM.  I know you were there and you would have heard a man report to the administrator that his services had been cut off by unknown persons.  In response the administrator stated that "no-one had the right to interfere with other residents services".  I spoke to the man outside he introduced himself as Roger and informed me of his suspicions as to who the culprit was.  Yes my dear your husband Mick.  He also stated that there were others that had been put in a similar position to himself.  When you discussed this you certainly enjoyed the fact that whoever you were discussing had been cut off by yourselves and in your words prior to you leaving for your UK christmas break "we cut them off and left for the Uk the following morning".  I don't know who this resident was but obviously you do.
