Got back last night. Workmen still installing street lighting and power boxes being enlarged.

Weather shocking from Sunday 27th to Wednesday 30th. Cars bobbing up and down with the volume of rainwater being washed down from the hills into the village !! Emergency services worked thru the night. EP not too badly affected, except you couldn't leave your house !

The administrators referred to are nothing to do with San Jose's Administrators, but would be Community Administrators who would currently oversee the water/electricity payments, community charge (20 euros a month currently) and would hold all the owners details.   Once we have our habitation certificates and our own meters for water and electricity,  they would organise the maintenance of the pools, communal areas, etc.   

So far, a resident at El Pinet has been acting as Administrator but he resigned at the AGM in July and the Community will need an official, qualified Community Administrator, which all residential developments need to have.   All owners will pay an annual/monthly fee for this work together with charges for the upkeep of the site.   I'm not sure how much the Council will be responsible for, but whatever they're not, then that's what we have to pay for.

I don't know which Company Bo and the rest of the Committee are negotiating with but I've been told they're in Elche.   As an owner, I'm very grateful to Bo and the rest of the Committee for all their voluntary efforts on our behalf, and am happy to trust them to find a suitable Administrator.  

I hope this information, such as it is,  goes some way to answering your queries.    I shall look forward to the next post on the El Pinet website which hopefully will give more information about the new arrangements.

Hi Everyone,

Good to note we are in the process of appointing a Qualified Community Administrator.  Well done to Bo and the rest of the Committee for their efforts.

Whilst we are on the subject of  charges have just calculated that to date I have paid 700 Euros in maintenance and community charges. Those on site permanently even more.

Call me cynical but I hope the new Administrator has better luck in getting money out of all the non-payers!!

Will be interesting to see what happens once they start issuing Habitation Certificates.

Thanks for the explanation Let's hope the new administrators fees are reasonable as these will now have to be paid on top and as Vagabond says that the  non payers can be made to pay up  to lesson the burden .

I still have reservations regarding  the  wisdom of setting up a community / residents committee or administration while there are still legal questions regarding San Jose's situation and obligations regarding the site and  unpaid debt etc .

The way I understand it  the community could be liable for certain aspects which San Jose were  previously responsible for . I have taken advice on this from various sources and have been told  it is best not to start a community until the developers issues and the situation of  the site  are resolved . I understand the predicament residents or people renting property  are in but still feel all this may come back to bite  . Not sure what to think now . Has the community sought any  independent  legal advice on this .I have and what is happening goes against that advice .

I totally agree with you. I think that the committee on El Pinet are causing more problems for us in the long term by employing a legal administrator and taking the "heat " off San Jose. Once a community has been legally set up it is their responsability for take on all debts. Until we have our certificates, we can pay to help with costs but are not liable.. After... I believe we are and .we may be causing too many problems for ourselves.

Hi Profe I think this situation is more serious than some understand . I have been legally  advised it may be better to walk away than to get involved with this community  vs San Jose situation .

Legally there should be no one living there or renting ,No one should have completed without a LOFH .San Jose have renaged on every legal obligation so far .Does a leopard change it's spots . 

 I believe it was San Jose who first suggested forming  a  community .The formation of a community lets them off the hook in many ways .We are now  playing right into their hands .

Sheer stupidity and lack of accurate information  the very thing San Jose have relied on all along .Act  in haste repent in anger .There have been many on here who have suggested taking legal advice before deciding anything .they were blown out by the committee .Why !

Correct me if i am wrong but i remember reading a while back about a development at Torrevieca where the residents had been waiting around 30 years for the place to get finished and where the town hall had called for the residents to pay to finish everything themselves.

I really hope that the committee members have taken good legal advice as if it is true that SJ have been pushing for the committee then you can rest assured that it can only help them as they don't care about anyone else!

Hi FAR and others,

I agree with the comments that we should have got legal advice as SJ will just walk away and we will for sure pay 10 fold!

As for the comment that some have made about not paying for things. I will again point out that some have been advised legally not to pay. I believe in paying the community charge but am not sure of this water and electric charge.

Unless someone can explain to me why it cost more in Spain than any where else in the EU. Then I will pay on a what I use when basis!

What 'Legal advice'? This has already proved to be a joke as we have all been sold properties illegally without FLO's on supposed 'Legal Advice'. What had become accepted practice in Spain was totally illegal as we - along with thousands of others - have all now found out to our cost.

I think our best option is to stick together as a Community and support our Committee who are working for the benifit of us all and we understand they do have advice on how we should best proceed.

It is a case of fingers crossed!!!!!!!!! That probably works as well as the 'legal advice' in  Spain.

Agreed CeeJay.  We all employed legal representatives, and we still ended up in this mess.   Who's to say they won't make matters worse, and at even greater cost to ourselves.   Some of us have supported the committee ( financially ) and residents ( morally ) since the beginning. I will continue to do so.   If others choose not to, so be it. I feel certain that if I need the committee' support in the future, they will be there for me.

Have you seen the minutes of the latest Committee Meeting held on 31 October posted on the Blog?  Interesting reading -   Spanish law is a myriad of ever decreasing circles which eventually disappear into a big black hole!! You get an answer to one question, which opens up another question and so we go on, ................

"woken up at 8am with the builders digging outside our house, putting new telephone cables in the road, they are under the pavement at the moment and need to be moved!! Mustn't complain!!"

Hi psbohy  the forum has a rule that  you must post ( I think it is 10 safe posts no spam or advertising  ) before your PM facility is activated . Sending PMs or even accessing the  PMs you have  received is not allowed until you have made 10 safe posts .

I would have thought you were up to 10 posts by now but perhaps not .

If you have posted 10 or more posts you should contact the EOS team for help  .  If not just make a few more posts and your PM should kick in automatically . Keep the info from El Pinet coming .Thanks  MM
