Hi,

Is anyone able to attend this AGM which we have just received details of. We are unfortunatley unable to attend, owning an apartment in block 77, but would like to give someone our proxy vote to ensure our views are heard. Having seen how many defaulters on the community charge there are, I want to ensure that I can vote for legal action to be commenced against all the non payer. Horrified to note that nearly 33,000 euros is owing just in our small area.

Please send me message ( can't pm me yet I don't think).

Would like to say however that I am still of the view that Roda has been a good choice. We have been renting out for just a year, but have had good feed back, particularly about the golf and this year have had repeat enquiries. We love our visits and this is still a good area to visit. Golf will always have a draw.

We're at Roda at the moment, and will be remaining until shorly after the AGM.  We're on Phase 3a and hope to raise some pet issues at the meeting.

I have been told that quite a number of those not paying fees are Spanish, and that this in at least some cases its their way of protesting at things (snagging issues) not being put right.  Not saying that I agree with it, since its other owners who it hurts in the long run.

Also since those who have not paid have now been reminded, I believe the next action will be to instigate legal action against them.  But the process could be a lengthy one.

Have to say this idea of not paying community fees because of Roda's problems is not confined to the Spanish, those that do it obviously either do not know how communities work or are just plain bloody minded As you say it is the rest of us who suffer.

I believe first action is to add a 20% fine for non payment but the community has to decide at what stage this is imposed, then legal proceedings will have to follow and as you rightly say this takes time in Spain especially as many owners simply ignore the demands for the fine as well.

I paid community fees by direct debit,  and I though AGM was in January, I am on phase 3 B.

Have just been reviewing last year's docs from the AGM - noting the names of attendees, proxy votes etc.  At the time, Roda Golf are shown as responsible for 47.32% of community fees.  Of the list of actual owners, only 2 names appear on the debtors list recently circulated - 21-74-3-a and 21-63-3-a.  Can we assume then that the bulk of the debt is owed by Roda?  Of are there actual owners who simply either didnt attend, or allocate their proxy vote so dont show on the minutes and co-efficient breakdown?
