Hi all,
Can anyone give me anyinformation please. I would like to know if el Pinet has any finished properties or indeed residents. what's the general opinion of the development and its location.

Hello Sterling,

I know there are residents living there for at least 4 years
I transferred from Albatera to El Pinet in April this year but it was extremely difficult, around 2 years ago we were told that there were no properties available and this year we only just managed it as someone had to pull out after being refused a mortgage.
I dont know if there are any resales

The area is very beautiful with salt lakes and blue flag beach only about 5 mins walk away
It is only around 15 mins drive from Alicante airport
Santa Pola, Elche, Guardamar, Torrevieca, La Mata are all near by
La Marina the village itself has everything one would need

There are few properties in total to be built there and i am to believe there is to be a hotel and the shop units or at least some of them have been built
The climate is lovely with usually a nice breeze

El pinet has lots of residents most of the completed properties are occupied by owners `or let out long term or as holiday lets  ,there are a few properties for sale but privately not by the developer.I have asked many times over the past 4yrs to switch to any key ready properties in El pinet and have always been told by SJ that there are none available.
As  for the development and location what can I say ,Perfect for me .walking distance from beach and village,15 min from Alicante airport 45min from Murcia airport. 
Alicante ( Great city great shopping), 
Santa Pola ( one of the best fish markets I have visited  and best fish restaurants ever) ,
Guardamar Del Segura (a beautiful seaside very Spanish town ) a short drive ,bus ride away.
Inland beautiful towns and villages.
 At least three golf courses not far away.
La Marina Urb  not too close but close enough if you fancy a full English now and again.(not my cup of tea but there if you want it ) 
National park ,bird watching  ,  salt plains , flamingos ,naturalist  beach,  unspoiled natural  wild beaches with wonderful sand dunes ,boat trips to the secluded Island of Tabarca . What more can I say. I think it is wonderful .Oh no Sterling you are making me dwell on all I have lost.  All this and my money .I am now going to go and  slit my wrists. JA

Hi Stirling (we're from Kent too!)

What's happening with the build at El Pinet - are they able to carry on with this one?

Mark & I were down at El Pinet on Saturday - didn't see any activity - it felt a bit like a ghost town!  It is a beautiful location and as JA says just a quick stroll to the beach.  We saw a lot of buildings in progress still many on builders utilities.  Could not see any established amenities i.e. supermarket, restaurants, etc although there were some units being built clearly for these in mind.  There were a few properties up for sale, even a Rosita for sale with San Jose!

To be honest with all that we have been through with San Jose at Jumilla would I choose to put my trust in San Jose again - no I wouldn't but if eventually the only option was to consider a transfer to El Pinet or lose my money - I would have to think about it seriously.  Although it seems from everything we're hearing there are no properties available through San Jose at El Pinet anyway so I guess it's back to square one!

I believe most people (myself included) that have a property on El Pinet received an email from San Jose today asking for 120 euro's each month to pay for the electricity and water!! This has been requested by the administrator - although the bank details for the direct debits are to San Jose bank??! I have emailed back asking for furhter clarification and explanation. I will update if and when I get any info. Obviously if anyone else knows anything please post.

 It would be wise to check your contract .I believe there is something written in the SJ contracts about electricity  and utilities,well there is in mine but t as my property is not yet completed , I have been through the contract with a fine tooth comb.It says something about electricity and utilities being the responsibility of SJ until all documents and certificates are available and the utility companies are able to take over from builders supply,This is unlikely to happen until the site is completed  .From what I understand it is SJs responsibility until this is possible.Worthwhile to check it out.  I think SJ are just trying to gather money from who ever and however they can because they are cash strapped . Why should you pay yet when they have failed to provide the infrastructure completed roads and pavements and amenities that have been promised ,They should be compensating you  as they have forced you to live on a building site for so many years.

Would be interesting to figure out how they have decided who pays what as there is no way of monitoring individual usage the amount people use would of course  vary depending on many factors ie  how often people use their  house or if they live there full time , how often they rent out and to how many people ,some people are wasteful of energy and some are not. Makes you wonder eh did they just pluck a figure out of thin are.. Having said this a worse scenario is if SJ can no longer pay and have there supply cut off  before utility companies are ready  or able to take over supply .I have read about this happening on other developments when the builder was in financial trouble and it was no joke for those concerned. JA

I too have received San Jose's letter requesting the 120 euros a month as I have a holiday home at El Pinet.   I gather from a friend who lives there that they're having a residents' meeting with San Jose representatives tomorrow evening at the site office.   My son is out there at the moment and plans to go to the meeting so if there's any news I'll post it here.   It seems that some people are refusing to pay as they say it's illegal.  I shall wait and see what comes up at the meeting.

120 euros seems a bit steep if you only spend a few weeks a year in your property. If you had the choice of being connected to mains supplies you would only pay for what you use plus a small standing charge .How can SJ justify this when residents have no choice to be connected to mains supplies or chose there supplier  and be metered for personal usage only.Once agian  all of this through no fault of their own.
 It must  also be considered that as El Pinet is basically still a building site and has been for 3yrs residents have been unable to rent or can not charge market value for rentals. Also building supply water and electricity is sporadic and unreliable .When I was renting the water and electricity were off more than on and power was often cut out due to overload .
What of the inconvenience and money lost  in rental value to residents who did not buy in to or ask for any of this. With the dodgy dealings of SJ who is to say any money paid to SJs account will actually be used to pay utilities. 

Letter from SJ

 

On May 20th the Mercantile Court number 2 of Alicante,Administration Proceedure number 278/2008 A, declared the company SAN JOSE INVERSIONES Y PROYECOS URBANISTICOS,SA, in Voluntay Administration, motivated by, among others, the financial difficulty that the company has been experiencing in the recent months.

Despite such economic situation, the Company has endured over the past 3 years, as one its highest priorities,the cost of water and electricty consumption of the properties in the residential,its purpose being to meet the cost recruited by each owner's water and electricity services until the habitation certificates are granted,which will be when each property will be connected to the respective supplier companies.

However, given the current difficulties of the company to meet the high costs incurred by such consumption, we are compelled to have to announce, following expicit instructions from the Court Administrators, that henceforth, (including August) and until the final hiring of services for each individual owner, you must all help meet the cost, transferring to below account, the amountof ONE HUNDRED AND TWENTY EUROS a month (120E). Revenues should be made between 1st and 5th ofeach month, except for the month of August that the above amount must be paid before
the 25th of September 2008.

I am in the same boat and just received a letter to my London home to ask for money.  I feel the same way as others we have all suffered through SJ.  However what happens if they stop delivering water etc are we able to sign up for electricity /water and if so how do we do it?  Hopefully from the meeting we shall find out what the score is.  I am going there next weekend so hopefully will speak to some of the residents there to see where we stand.  Fantastic place once it is finished!

I would suggest anyone who actually has a certificate of habitation should try and sign up for  mains electricity and water supply.Then we will know if it is possible .I would think it is not yet possible ,if it was SJ would not be asking for money but would be saying please sign up for you own supply now .The whole thing is ridiculous I urge everyone to check the part of the sales contract which covers this situation. JA

The letter you have received has been sent from San Jose but authorised and written by the Administrators"

"The amount of 120Euros has been calculated by the Administrators taking into consideration what consumption is used per month since 2005.
All property owners will pay the same amount, those who live there as well as those that do not."

I then asked whether we were being asked to pay retrospectively. Their response was " The Administrators have taken the period until today as an example of what is used each month, in order to cover the costs from August 2008 until we are able to pass you on to your own meters. You will be payingfor the cost you incur from August 2008 to the time that the meters are installed.This amount would have to be paid for the connection to be continued, being in Administration due to financial difficulties means we are not able to proceed with such payments. We would want to proceed but we are physically unable to do so and do not know for how long this situation will be for but we hope not for long"

I also asked when they expected to finish the site. Response " We want to commence work as soon as possible, once finance and licenses are in place. A completion date will be confirmed then."

I have now heard from someone who lives at El Pinet and who attended the meeting yesterday evening of residents/owners and people from San Jose.   -

There were lots of angry people at the meeting.  Two Spanish guys who live at El Pinet are going to go to the administrators and request a meeting.   They will ask for a complete break down of where the money will go and will pass on our questions.  Basically most people who attended the meeting are prepared to pay for three months with the assurance that in writing it is stated that by the 4th month the site will be ready for inspection from the council for our certificates.  San Jose have had permission to continue the site since May but have not had the money to continue. The Administrators have just come to an agreement with a Spanish Bank to back them to finish El Pinet.  Until that time there is no money to pay for our water or electric.  This order/suggestion has come from the Administrators.  If they dont get some money from us then the utilities cannot be paid.
I think something will be sorted quite quickly.  The other suggestion was to get permission for everyone to buy a meter and have it fitted  to our homes.

When I hear anything further I will post it here.

Hello

I have just received an email from Pilar via my agent this morning
San Jose are still waiting on reactivation of the planning license and the funding to finish El Pinet

Independent metre's cannot be fitted as they DO NOT have the habitation document

The 120 euro is the average expenditure from 05 until now

This amount will apply to all owners resident or not and anyone who does not pay will not have these services, water electricity etc

This will continue until the habitation license is granted

There was no mention of a spanish bank agreeing to give them the money so i dont know where these stories are coming from

Quite frankly it is out of San Jose's hands and with the administrators so you either pay up or not have any services
and for how long is anyone's guess really

SJ have a legal obligation to make sure that each property is ready to receive their own supply of water and electricity only then can they ask for the payment for what has been consumed .This fact does not help those who need water and electricity but paying does not guarantee SJ will 1 use the money to pay for utilities or 2  will ever have the finance to get El Pinet  finished or to the stage where residents will be in a position to secure their own supply.Once again SJ has their customers between the devil and the deep blue sea .Absolutely disgraceful behaviour  I have come to expect nothing other than disgraceful behaviour  from them .I would hold off as long as possible before paying  we will hear from the judge soon and if SJ go under as I believe they will you will not see your money or water or electricity supply and will have one hell of a bill to put this mess right .  God help us all the more I hear the more I am convinced I can wave goodbye to the £ 70,000 they have stolen from me .Now to add insult to injury the Administrators have instructed banks not to pay out on SJ bank Guarantees . Now we all have to go to court .I have paid out so far almost £4000 for this privilege. SJ are a bunch of crooks and the administrators are no better than thieves. God help us all JA

We have now received the report of the meeting some residents at El Pinet had with the Administrators yesterday, which I will post below.    Regrettably this doesn't mention when building will start on the unfinished properties  but is concerned with keeping the water and electricity supplies to the finished properties until such time as the infrastructure is complete and Habitation Certificates are issued.  It is then that everyone will get their own meters.   I guess everyone who received the original letter about paying 120 euros a month will now get one requesting the reduced amount of 60 euros.   I personally believe it is imperative that we go down this route and all pay the 60 euros a month.  I know some people are saying that it's unfair that we all pay the same amount as obviously our usage varies enormously, but it would be impossible to work it out fairly at this stage and our priority must be to keep the supplies going for all concerned.     I'm sure we've all read in the Spanish press about other developments where supplies have been cut off -  where would we go from there if that happened at El Pinet?  

Meeting of 24th with:

 San José Inversiones y Proyectos Urbanísticos S.A. and the Administrators.

 As you know San Jose have Financial problems and are unable to pay their suppliers and they have asked the owner to pay 120. - Euros per month for water and electricity.     At the end of the meeting we agreed that we would ask owners to pay 60. - Euros per month for September to December. This have not to be paid immediately; we will let you know next week when, how and to whom. This amount is based on San Jose expenses divided by 293 registered properties. 

 San Jose with the Administrators have plans to implement a timetable for the roads and the lighting which will enable us both, the houses and the apartments to obtain our habitation certification. This is hopped to be finished as soon after December this year as possible. At the very least they hope to have started the work.

If these plans are not implemented then we will have to go back to San Jose and the Administrators for more discussions as to the future.

 We have seen bills from San Jose for August this Year, but as you know this is a busy month so San Jose have agreed to show as bills for three normal months. This will give everybody a better idea of the actual cost of the expenses that El Pinet has.     After December one possibility been investigated is the provision of water and electricity meter which will be a much more fair way for each  to pay only for what he uses; this will be especially important if this issue continues for a long time.

 We would recommend that everybody pays this amount until December as failure to be united will not give the right impression to the Administration and the Court. We also think that to pay this amount will benefit everybody as we hope to have a better living environment and of course Habitation Certificates. This benefits Residents, people who are Renting Properties and to people who wish to Sell.     For all the people who had paid recently an amount, this will reduce the 120. - Euros required early in October. Also to clarify we agreed not to pay the expenses of August.

If cash flow is so tight where on earth is the money coming from to finish the roads and lights let alone complete the half built properties .The situation is very worrying .What about the Idea that another memeber put forward that SJ should be asked to confirm that the finishing of El Pinet is indeed a priority as they have said so many times before. The way they have moved to concentrate on newer developments before older ones are completed is half the reason they are in this mess.Is it possible to get some assurance of what is priority for them if they are able to secure finance which I must say seems unlikely JA
