Transfer of property in divorce settlements

Hi,

just thought I'd post a warning to others regarding whats just happened to me.

I was contacted over 3 weeks ago from Polarisworld with regards to my completion date being confirmed for the 21st August.
I contacted my bank (Barclays) and also my solicitor (Gonzalo Ross), and asked if they could foresee any problems with this date for completion and I was assured everything was in order.

Anyhow I then proceeded to book my flights and hotel accommodation. Flying over on the 15th August and coming home again on the 23rd August, with the intention of going over there to get my bearings, complete all paperworks and finally get the keys.

Imagine my absolute horror this morning when I was contacted by the completions department which has informed me that the completion date will now no longer be the 21st August but 'most likely' the end of August!!

After repeated phone calls and emails flying to Spain, the only option I have is to go over as planned (time of work is one thing but cost of flights and accommodation another consideration), on the 15th August. Complete and sign what I can.
Then I have to give my solicitor Power of Attorney over my signature, which I knew was an option before, but seeing as I'd never actually met the guy and have only spoken to him on the phone I didnt really want to do.

Then my solicitor will be able to complete for me at the end of August.

Polarisworld have actually stated that they will bear the cost of this.

However, if I was to have gone down this path from the outset, which I didnt really want to do, I could've saved myself a small fortune in flights and accommodation for myself and my girlfriend. It kind of negates the whole purpose of me going over there now.

I am not happy about this at all. In fact earlier today at my lowest point, if it wouldve been possible to pull the plug on this 'Dream in the Sun' I would have. 

Now all I'm left with is a sense of frustration and all the excitement of actually going over there to get the keys has now gone.

I hope anyone else reading this doesnt go through the day I have just had, however I would implore each and every one of you to get it in writing (like I did) from Polarisworld when they give you your completion date.

Gutted...absolutely gutted.

Sorry to hear your dates have been bodged up by PW, it isnt the 1st time they have done this, and I am sure it wont be the last.  I was lucky that my completion went according to plan but I would have felt the same as you had it not.

I know its no consolation and like you said its wasted time and cost for you both but hopefully once you have got those keys the funtimes can be had.

Nice to hear from another Jardine 8!  
Sorrry to hear of your dissappointment  with your cancellation of completion. I know the feeling even though I was completing last Wednesday 6th Aug by POA I didn't know until wednesday that I wasn't going to complete now until the end of the month! Due to no Habitation Certificate!!

 That bottle nearly got opened!

 Unfortunately in Spain its shuts down in August for holidays, and if it doesn't shut down it goes on a go slow.......

Hope when you get over the disappointed,  that you have got an opportunity to go over and see whats going on!
And we hold you to take as many photo's as you can please!! Especially Jardine 8!!!!!

I know it doesn't make you feel any better but its happened to a lot of us. We booked flights etc for July and ended up with POA to complete due to no Habitation certificate.
Keep cheery and it will all be worth it in the end.

Enjoy your time out in Spain and Good luck for your completion.
We are in 9 so just next door, beer will be chilled in fridge when we finally get over in September to sort everything out so if you are about pop in.

I've just had word that this delay is due to them not having the Habitation certificate, and its true what you said about the August holidays scapa..its taken me a week to get hold of my solicitor to find out what the delay is!! grrrrr

Anyway i'll be going over there on the 15th as planned to sort out what I can, whilst leaving my solicitor to finally complete for me when they get the paperwork sorted out..still not happy but what can you do?..they really do operate on a different timescale than us Brits :)

I'll take as many photo's as I can of Jardin 8 and post them when I get back.

Fortunately PW have allowed me to go ahead with my snagging visit this time there, so thats a bonus considering they tell you that they will only allow it a maximum of 4 days prior to completion...so fair play to them for that.

Will definitely pop around for a few cool ones in September stonephil and would like also to extend the offer to everyone else, provided of course I've got a fridge in by then lol

Hey dwinder72 just seen alwalky from the Condado De Alhama thread is going out Friday too! He is supposed to be completing 18th but he doesn't hold out much hope.  He's in Jardine 8 too!!!

I know it stinks we were in same position, however there is light at the end of the tunnel we completed 4 weeks  later than planned with the solicitor using their power of attorney. However its ours now and cant wait to go and visit!!! Flying out tomorrow to check it all out! very excited!!!!
