JUST WONDERING HAS ANYONE STARTED LEGAL ACTION TO TRY AND GET THERE MONEY BACK? IF SO I HAVE A FEW QUESTIONS I WOULD LIKE HELP WITH

1. DO YOU HAVE A GUARANTEE OR NOT 

2. WHEN WAS/IS YOUR CONTRACT UP

3.HOW WELL IS THE LEGAL ACTIN GOING

4.FINALLY HAS YOUR SOLICITOR GAVE YOU ANY IDEA OF THE COST OF TAKING SUCH ACTION.


EVEN IF YOU CANT ANSWER ALL OF THE ABOVE QUESTIONS ANSWERS TO ANY OF THEM WOULD BE A GREAT HELP TO ME AND MAYBE OTHERS WHO ARE IN LIMBO. ITS GONE VERY QUEIT WE STILL NEED TO STICK TOGETHER.

Hi, I am being represented by a Lawyer in Guardamar (Alicante). Her name is Guadalupe Sánchez and the name of her firm is GMLEGALEXPERTS.

She got on my behalf (and on behalf many others Irish, British and Spanish clients) the bank guarantees executed, so I received my deposits back plus legal interest.
Now she is going to bring an action againts Trampolin on our behalf to claim the money paid in cash (together with deposits paid by some clients who did not have a bank guarantee). She explained me that on the claim she is asking for the urgent seizure of Trampolin Group Properties (lands and properties in another resorts) to make sure our money is guaranteed if TH does not paid or gets into liquidation.
I dealed with some solicitors before appointing GMLEGALEXPERTS, and I have to say they are very proffessional and efficient (they got the guarantee executed  and paid in 15 days time).
She may ask you for a power of attorney (for the Court of Justice) and her fees are fair: I paid her 1,500 euros to get the guarantee executed and be represented at the Court until the end of the process.

Hi I cannot speak for anyone else, but I know someone using the solicitors mentioned by Lyla and unfortunately Trampolin hills HAVE NOT refunded ANY money even for those WITH bank guarantees. This is after 6 weeks of chasing them and serving a notice on them. SO THIS IS NOT TRUE. Cheers

jackie, why are you lying? Myself, and three friend of mine (Irish) have already got the deposit covered by the bank guarantee back, increased by the interest. I do not have any problem to prove it if someone request it. THE MONEY IST INTO MY ACCOUN! HOW CAN YOU SAY THAT IT IS NOT TRUE?
Who are you really? Are you a builder's employee. Someone mentioned me that builder's staff is involve in this forum. I thing they were not wrong.
Jackie, you are not a good person if you are trying to protect TH just avoiding people to appoint a good solicitor

Hi when did your solicitor start the proceedings and how long after that did you get your money back. Also did you have to pay the fees before the money was returned or once you received it back

Lyla, why do you ONLY ever post to promote this law firm?  You never post about anything else apart from that.  You give no other advice or information, only post these lawyers details.

Have you any proof to substantiate your claim about these lawyers?  We are always happy for people to recommend good lawyers but your posts have always been very suspect, as if you have an ulterior motive.

Hi although I haven’t bought on TH I have a house on Lo Santiago ( still waiting for escritura) and I keep reading that people want to take legal action to regain monies paid I can understand everyone’s frustration and disappointment but if you all take this course of action all you will do is force the company into liquidation and everyone will have to join the queue for what is left after all organisations are paid out eg hacienda etc, so I know it may be a hard thing to swallow but in my opinion you are all on a “roller coaster “ and you will find it very hard to get off and you must all pull together and put as much pressure on the town hall as you can and you should be ok, or all take legal action and their will be a lot of disappointed people with nothing.

I do recommend to contact the lawyer because I am not one, I am not quite sure if my advice is the correct one.

I got my bank guarantee executed on June 6. The bank who met the payment was La CAIXA, and they paid me back they deposit I paid in 2005 for my property Triana (€66,750) plus interest €8,200. Now my solicitor is in the process of getting the cash back (€29,000). She told me that we are going to be probably on the newspapers soon, because she is currently representing 20 owners, and request some properties repossesion to cover the deposits until the end of the process (I am no quite sure about how this works).

About the fees, she just charged me € 1,500 when she got the Bank Guarantee executed, and whit this fee she is going to represent me until the end of the Court process.

I did not want to seem suspicious recommending a lawyer, but I think the ones who should provide advice are the experts, because some people involved on this forum is not "clean" and does not provide good advice.

I am Spanish, from Madrid, but my husband is Irish. We spent more of the time here, In Spain. We bought a property near La Marina, and we wanted to move to Campos del Rio (a broken dream!).

Ok. I understand.
Sorry for the "publicity" I have made to my solicitor. I just wanted to help, because I know that many buyers, like I was, must feel very concern, and I am lucky because the solicitor got my money refunded. I just wanted to state that legal actions are being taken and buyers are getting money refunded.

I respect the people who thinks that to take legal actions is not good because can produce TH liquidation, but I have to say that, in my opinion, they won't get into liquidation because we are asking our money back, because they do not hold that money now (I am quite sure they have spent everything)...They will get into liquidation because there are no sales, and if we do not cover our back with the seizure of assets I think we are going to be the last on the queque.

I haven't looked at this site for a while as quite frankly, have got fed up with it!! 
I have just read one part that says some clients have received their deposits back!!! Good for them!!! We have , in writing from Pilar Cano, Lawyer to TH signed by her, a statement giving 3 options!!! One to have the deposit back, another to  give TH the opportunity to sell the property on  [what property], and the last to be paid interest on the deposits from the date the contract ceased till receiving key!!
When our solicitor contacted Pilar Cano to discuss receiving deposit back, she stated they are not
giving money back!!!  No surprise!!!

Hey ho!! This is Spain and they think they are a law unto themselves.. We are seriously considering going to the European Courts!!!

You are right Clavel. They are not giving money back because they have spent all our money. I am susprise that there are still some people trying to sell that we do not have to bring actions against TH to avoid the get into liquidation....They have already spent all our savings (probably in the last Ferrari bought by Antonio, the manager).
Spain must change its rules indeed. I do not understand how TH is still selling properties and you can see advertising on motorways and press about illegal properties!!!
I am lucky, bacause my solicitor got the money back for me, but the people without the Bank Guarantee should feel very concern about their money.

i am not trying to "sell this idea" how can you be surprised by me saying it is not a good move to try to reclaim deposits by your own addmission you believe that TH have spent all the money so they have very lettle left until the building project is given the final license so this means they have no money to pay back and people sueing for the return of the deposits will only force the company into liqiudation this is just simple business nothing more nothing less so i am not trying to tell anyone thier best course of action but just stop and think logically before you all persue the legal route and yes all the lawyers will be saying yes i will get your money back but they will all want thier money up front and the saying "blood from a stone" comes to mind

my point is if you say they have spent all the money how can you recover deposits paid in cash and left with no bank gaurantee as they have no money all you will do is force the company into liquidation i not trying to make a point just simply state plain business rules

I agree completely with what Andy says. It's not as if the company have just closed up shop and walked away. Some work is still going on by all accounts and the company is waiting like the rest of us for a good result from all this political in-fighting. Mind you, if it is such a foregone conclusion, why the heck can't they just get started with the main work?

Hi All 

As I posted at an earlier time there is a lot of infastructure in place including sand, ballast, trucks, cement towers etc on site if he was going to do a runner he would have gone by now and not spent loads of excess money on all this infastructure.Yes he drives a posey car why not he is a sucessful busisness man if I was in his place I would probably have one as well and anybody says he should not have one is probably just green with envey.

Antonio usually builds the properties first and then worries about the licences after on this project he is trying to do everything legal TH have all the other licences in place and are just waiting for licence to build.

Polaris world only have to ask and they get their licence to build signed almost immediatly questions are now being asked of them why all the other licences are not in place and there is talk of irregularities to the extent that the owner of polaris world and the financial director were arrested recently.

so if you think TH is dodgy what do you make of polaris world????????????

I just wish you would stop being so negative and anybody wanting money back would (because of the justice system works in Spain) have to wait about 3 years to get their money back, or monies owed to them such as agents etc.

And before anybody askes no I do not work for TH I am an investor.

Thanks Ruoghdiamond, for bringing us back "to surface"

As we have discussed earlier, the only way (that at least I can see) is to stick with TH and help pushing the development to happen.

We just have to hang on to the surfboard and stay on the wave, I think it's a good one
