Answering an EOS members congratulating us on our victories with law 57/68 cases

Antifreeze:

It is very good  (1) Judges in Spain are applying Law so wisely and correctly in favour of consumers of those crazy years.

(2)Good that people like Keith Rule persisted on finding justice and finally,

(3) Good that we have the will, energie, passion and discipline to help Keith and many like him.

I am very glad for that all.

Indeed Maria. 'Negligent' banks, developers and lawyers ignored the law; supposedly the very best protection for buyers - now they should be brought to rightful justice. These organisations pulled the wool over ordinary peoples' eyes and failed to protect them by taking away any rights. The regional courts - mostly ignoring or failing to apply this legislation. That is worrying - and one could ask how did that occur in an EU democracy?

Hopefully now, thanks to Keith persevering, it will help consumers and moreover, revive the Spanish economy which was so strongly based on developments, foreign investment and the service industry. It has had such a negative impact - perhaps now,fresh buyers may have more confidence with protection. The sun still shines in Spain.

Many thanks to all those of you, who are able to help the purchasers like myself. This dreadful situation, not knowing how safe our Spanish Property purchases are. Especially Keith who Maria tells us of the great help he has been.

I prey that at last we can stop worrying about our Spanish investment and enjoy the homes we purchased so many years ago.

Sincere thanks as ever for all Keith's and Costa Luz's hard work, endeavours and courageous and dogged determination to gain justice, but there are still many waiting, waiting, waiting for justice a decade on, whilst the Banks continue to challenge and deny their responsibilites at every opportunity.
There is still a long journey ahead before sufficient Supreme Court doctrine is established to say hand on heart that the Banks have been made fully accountable for their negligences.
But as ever I live in hope and in the interim will endeavour to seek out the realities and strive not only for justice but also for reform, which hopefully will be to the longer term benefit of all !
Thank you Maria and Keith for your patience and educational input to assist and inspire those of us still striving for solutions ;)

I second that ads. Without this input from Keith and Maria, who can say where this would have led? At least it's on the correct path. I still feel there should be accountability as many of us have faced ruin, due to dishonesty and injustice. Slim chance of finding out why it all went so wrong.

We were trodden on in our ignorance, at the mercy of banks and developers who, misled us for their gain.

Hi Marie
After reading the latest blog on the Keith Rule, I thought I'd let you know on our outcome in court October 2015.
After reading about Keith's Ruling as we had exactly the same problem, so our solicitors took La Caixa bank to court. Well the outcome was we partially won with no court cost to us, we ask our solicitor what went wrong. Well the judge ruled that la Caixa was at fault, but the judge believed we had made no deposits payments. We asked our solicitor why we wasn't asked to show our receipts of proof of payment, he informed us that he informed the courts it was up to la Caixa to prove that we didn't pay...we are now appealing the judgement, but very confused why we can not show our proof at the appeal, as our solicitor informed us we can only submit again it is up la Caixa to prove otherwise. Has anyone had the same outcome, after 10yrs of fighting for our hard earned money it looks like it's finally going down the drain.

So many of the purchasers who have suffered the multitude of problems because of the money grabbing companies said to be fully legal, Obtain a mortgage (maybe from the Builder) that they will have to pay for years, or loose their Spanish Home. There are also those who had spent their life savings & paid cash to avoid any interest. Once retired taking on a loan of any kind would be a great worry, therefore, the only way to purchase a home in Spain it to empty the savings pot. The dishonest legal teams when purchasing our property let us down. To Lawyer & Spanish Notary based in Alicante, World wide Agent who advertised on International TV. The Builder who failed to supply the products we purchased & left thousands of euro debts which our community Funds. 9 years later we are still paying huge community fees to keep the community afloat. Yet the Builders debt to the Community is in excess of €100,000.00. This Builder has been allowed to carry on Building by using Umbrella companies which the Spanish Government allow to continue Trading, cheating yet even more Innocent Purchasers. This is where the Banks & Local Government in Spain are letting the innocent purchaser down. Thanks to Maria and Keith RULE are shining because they have continued to work at getting Justice to All those who are suffering.

People paying a mortgage on an illegal property can ask for all money back from banks too. We have already designed the action. It is simple and clear.

AS a community, start acting for the community to be maintained by whoever is debting that all. Use strong actions by determined lawyers.

As a matter of protection of fundamental right for housing and dignity
