Legal tip 1106. Supreme Court, video surveillance and right to privacy

It is not a black or white matter.

According to Supreme Court and Constitutional Court in Spain, principles of proportion and equilibrium need to be brought to discussion when deciding on situations where right to safety of a person can collide with right to privacy of a different one.

So.. there is no strict formula, every case is different.

so if a neighbour assaulted me sometime ago, and i put up a camera to cover my entrance gates and garden for security purposes and this camera just happens to pick up my neighbour´s (who assulted me) activiate just in case he tries to assault me again and i can record it as evidence this is a good reason ¿ just your thoughts

It is not. Just a Judge could decide on preventive measures which limit fundamental rights.
