Please don't assume/judge that all  those wanting to obtain their deposits back were in it for the money.  We have spent years hoping that all would be resolved and that we too could buy our dream holiday home in Spain to enjoy as you - but not at a cost. 

We appreciate that those that purchased did so early on and were happy to wait for the legal status of the complex to be complete at a later stage  - some of us were not so confident and decided to wait for the legal status to be completed and this is still not the case, despite what the builder might be stating - buying a property is a big commitment, I certainly would not buy a property in the UK in a similar situation as Jardines is still currently in - so why will I do it in Spain!

I can assure you if the complex was fully legal with no Court issues pending then I would have been the first in the queue to have signed on the dotted line!

We have been trying to withdraw from a purchase that was also due in September 2006, which has been delayed by the lack of habitation certificate - this eventually came thorugh in Feb this year at the same time as our starting court proceedings as the developer refused to enter into dicussions.  In the intervening period we have knowledge that the building licence on the complex has been revoked and we are still unable to complete - the buider still refuses to refund our money, even at our request of losing 25% of the deposit, which was in the contract if we withdrew before completion date.

It appears we have to take the very expensive court route.

We feel very abondoned, our legal representative give very little feedback, everything we find out about happens in Spain is through our own research - it just seems everyone is in it together!

Hi

I am not aware of anyone else obtaining a full refund.  I was made aware by our solicitor that she was representing 5 other clients from Jardines de Palomares who were originally give a resolution contract from the developer but the developer renaged their promise. 

We were informed in December from a representative of the developer that we can withdraw from the purchase of the apartment but would have to forfeit 25% of our deposit - this is now subsequently been withdrawn - even though it is  disputed that the complex is yet legal - whilst habitation licences have been granted the building licence has been revoked, I am told the developer has appealed against this.

Hi Jill

I hope you don't think I am imposing on your privacy and please don't feel obliged to answer any points you feel uncomfortable with.

Is your final payment date overdue?  There are a number of purchasers who have expressed to the Buidler that we want to withdraw and even though a number of us have commenced court procedings to recover our money we are being thwarted with difficulties.

The builder will not enter into negotiations, promises he has made to some of us have fallen though and not materialised.  We are being told that it is unlikely we will recover any money without us losing 25% due to the fact that we are withdrawing from the contract - even though the licences were extremely overdue and could not complete at the specified time.

We are now being informed that there is a possibility if we take him to court we could still end up losing because the licences are now there, it doesn't matter that there has been any lengthy delays, which appears we just have to accept.

I am curious as to what circumstances you have been able to recover some of your money without incurring a penalty clause of 25% when no one else has been remotely successful here.  We are in receipt of a bank guarantee which should guarantee our money but we cannot even seem to action this!

Anything you can highlight will be much appreciated.
