Hi,

we registered our claim for our deposit and responded to a lawyer contacting us to take up our case to recover our money. Unfortunately, as we only kept the physical paperwork for 7 years we didn't have anything other than some emails relating to our deposit. We passed these to our lawyer and, despite chasing, they simply didn't reply.

We were then contacted by another legal company who subsequently confirmed that they had found information regarding our deposit but then wrote to us and said the amount was too small for them to be bothered with! Our deposit was for 3000euros which is admittedly smaller than most people but still large enough for it to be worth recovering - especially as we're not working currently so the money would be very useful.

So, we're wondering what we can do next? Obviously there are some records of our deposit but are all lawyers simply not going to be bothered because the sum is too low or because we no longer have physical paperwork?

Is anyone else in a similar situation? Does anyone know of a lawyer who actually has the integrity to follow through on chasing this for us?

Can anyone give us any advice please?

We received a letter but we simply don't have enough time to get an apostille signed & returned to their offices by 5th May regardless of the cost - even if we wanted to.

They say that "unless we achieve a sufficient number of votes, the Company will be liquidated".

We'd already written off our 'investment' so anything we get back will be a bonus whatever the route.

We hope everyone gets at least something out of all of this.

Hi,

We've not visited this forum in a while (knowing that the legal process would grind on very slowly) so only just come across this thread regarding the emails sent out by the company.

We haven't received an email although I have had correspondence in the past regarding the claim.

Anyone else in the same boat and is there anything we should do?

Thanks for the offer of a translation of the letter we received MJB - have sent you a pm as requested.

I had really hoped that someone would be able to help us and share the spanish text of a letter to register the claim. I appreciate that many of you have much more invested in this and are paying for solicitors to pursue you claims and I don't want anyone to think we're trying to 'piggy-back' at anyones expense. Its just that the amount we wish to claim is almost the same as it would cost in legal fees so there is no point in paying for a solicitor. We're quite happy to just register the claim and let the process take its course. If we get anything back we see it as a bonus but don't hold out much hope and expect people who have more invested will take priority.

We just thought that, because in the past the people on this message board had seemed to be friendly & helpful, it was worth asking. We understand that everyone is probably more interested in their own situation so I guess we'll just have to try to put something together ourselves & send it in.

If anyone can help though, it would be really appreciated

Hi,

first of all may I say how sorry we are to hear of the problems facing people who were further along the buying process than we were. We wish you all the very best of luck in getting the solution you want - whether it be your house or a refund.

We only got as far as placing our reservation deposit but when we received the contract from San Jose, alarm bells rang as our own due diligence showed that  it was illegal under Spanish Law (something our Spanish Solicitor - PSI - didn't even pick up!). We tried to get it changed but to no avail, so we pulled out of the deal and ended our dealings with PSI. We also found, again from our checking, that the claims made by Ambasun regarding the licences were incorrect (we wouldn't have even paid the deposit had they not claimed that all licences were in place).

Since that time we've spent hours on the phone with Ambasun and sent many emails but they have, quite frankly, been a complete waste of time. Talk about take your money & run!

Anyway, we have now got our letter regarding the administration & know we need to register our claim. However, as the claim is for just 3k euro we see no point in spending a further 2-3k euro on legal fees to try to recover it. We would, however, still like to register the claim.

Can anyone help us with the text of a letter we could use to send to register our claim? I believe it needs to be in Spanish, hence the need to ask for help.
