Have not been on the forum for quite a while, have given up on it all really.  My solicitor says however that the list of creditors has been released but she has yet to forward it to me.  Does anyone know how I can get hold of it?

I think everybody needs to calm down.  People seem to be turning on eachother and as Brianmags has said, we want our houses but we also want our community.  If things do work themselves out, it would be horrible if there is hostility amongst the people who are living there.  People have invested alot of money and time into this and the thought of it all being lost and having no control over it is heart breaking.  Tonymal is just trying to fight for what he feels is right.  Maybe there are people out there that don't want to be attached to anything that may have repercussions in the future, but Tonymal has not mentioned any names.  Other purchasers have contacted him and expressed that they are really interested in continuing with their purchases.  If you do not want your house and want your money back then it has nothing to do with you.  He is speaking only on behalf of those who have had contact with him wanting their houses.  Looking at it, maybe he could have let people know what he wanted to do and got feedback as to whether we thought it was the right course of action, but at the end of the day he was only doing something that he thought would help.  If the banks think that everyone is just going to pull out, they may let that happen.  If they know there are people willing to continue, they may get it worked out.  I know San Jose have led us on alot, but they are under the courts now.  Everything is now out in the open and it all has to be disclosed to us.  Alot of people are groping about in the dark, and noone, not even the solicitors know what is going to happen.  We all will just have to wait until the courts come back to us.  In the meantime, I do not think anyone is saying that it is a bad idea to get your name down as a creditor and protecting your money.  
Alt of sleep has been lost by alot of people, but at the moment it is just a waiting game and name calling is not getting anyone anywhere.
Tonymal, if you can prove all that you say that is fair enough but if you can't I think alot of us just want you to be careful, ok?!

I am with you tonymal, I too want my house.  But we need to wait a few weeks to see what the banks and courts decide.  Unfortunately what we want is not always what we get.  I loved it up there and I saw the ideals that were set out to us, but it was planned to be a huge place and I do believe if it really gets started, people will start buying up there because it is so beautiful.  We will have to wait and see.  I am interested in what the spainsh are feeling.  I don't think the courts will care too much of the fait of the money for us 'foreigners', but if there are alot of spanish purchasers involved, maybe there will be a little more fight in the relevant and important places!!

My husband was talking this morning with our spainsh solictor.  She said that you have to pay for a barrister to represent you in court even though your name has been put down as creditors.  For this we have been quoted 1500euro as the solicitor and barrister has to be hired in Alicante where the courts are.  We said that we still want our house and her reply was that the main objective for us at the moment and what we need to concentrate on is getting our name down and getting out money back.  The company still seem to want to go on with the build and if it works out it is a bonus and we can go through that process but at the moment getting our deposits back needs to be a priority.  I too want my house for value for money, location and amenities there was nowhere else even came close.  If this falls through I do not want to settle for somewhere else but what if it doesn't happen?  We still don't want to have money floating about comewhere in Spain doing nothing for us.

Can anyone help me with a question that I have?  We were issued with a bank guarantee when we purchased our villa in SADM.  It has gone past its date and we wanted san jose to update it for us.  At this stage we were told that they were standing by all bank guarantees, as long as they were not presented to the bank, they were still valid.  They said they wrote and informed our solicitor(which she said she never got).  
Now when we heard about all of this we contacted our agent and solicitor and as lots of you know, nobody at this stage was aware of the problems and only til we told them did they start digging.  At the weekend we recieved an email from our solictor saying they needed to get our names on the creditors lists and because it was courts in Alicante, they needed to pay for solicitors and barristers there costing 1500 euro.  Now my question to all those who currently do have bank guarantees is, should we not already be down on a list of creditors by the company?  A bank guarantee is like an IOU if everything goes wrong (like now).  If this is the case why do we have to pay to be put onto this list?
I agree that the law firms are rubbing their hands together and already planning how they could spend our money.  They do have information to offer, but are they looking in the best interest of those who still want their house?  Or just what will pay them the most money?  Leaving the question, how much information can we take from them?
