 Thank you so much to all the people who have replied and assisted me with this problem.  It appears that some communities are applying rules and regulations at whim even though they may have checked things out with their administrators.  Apparently the administrators for our community do not see anything wrong in treating property owners and tenants differently.  In most cases, property owners and tenants do not know their rights and are unsure how to ascertain the legalities of them.

 At our latest AGM the vice president proposed to adopt a statute in the constitution prohibiting rental tenants from housing pets. It was proposed that the community does not become a home for rental owners who have pets and that any tenant renting property is excluded from housing any form of pet.

Surely this is discrimination against tenants...and what is the difference between a property owner having a pet and a tenant?  Surely it is up to the individual owner's discretion on allowing their tenant to have a pet.  As far as I am aware this cannot be applied and that property owners and tenants cannot be treated differently.

Could someone please point me in the right direction to determine if this is legal or not.

A report has been drafted by Danish MEP, Margaret Auken, in which she calls for drastic measures to be taken against the Spanish authorities who have turned a blind eye for years to the LRAU. ( land grab legislation)

Many 1000s of people living in Spain, including the Costa Blanca, have been subject to massive bills simply for the pleasure of having part of their grounds or gardens stripped from them. Also being forced to pay huge sums of money to unscrupulous planners, developers and even local authorities for the infrastructure that accompanies huge urbanizations.

Many properties have been branded as ‘illegal’ even after obtaining all necessary legal rights. Some have been demolished and the families are forced to find alternative accommodation without any recourse to compensation.

Families have been left in dire financial straights which seemingly has gone unnoticed by the authorities.

At last the European Union is paying attention to this abuse of human rights in spite of  having received three previous reports.

Spain could have its European funding frozen if they fail to act and now in these hard economic times that is exactly what they don’t need.

Hopefully compensation will be paid to the affected parties, both Spanish and non Spanish residents.

I would like to thank you for doing all you can to bring this to the media's notice.  I, too, am very surprised that only 3 people responded.  I sent an email to her immediately and  I definitely don't want to appear on t.v., but we can't keep burying our heads in the sand.  I hope the people who don't want to embarrass themselves remember that pride comes before a fall!!!

Please don't rely on what you have been told.  Our case went to court in March and 7 months on we still haven't heard anything!!!
